Terms of Use#

These Terms of Use ("Terms") are a legal agreement between you and MCCLabs, İstiklal Mahallesi, Piyaleoğlu Caddesi No: 141, Turgutlu, Manisa, Türkiye ("we", "us", or "our"). They govern your use of the Timofy mobile application, the website at https://timofy.site, and related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms, including the Content Standards in Section 6.4 and the Child Safety Standards in Section 7. You must accept these Terms before you can create an account or post content. If you do not agree, do not use the Service.

Our Privacy Policy, available at https://timofy.site/gizlilik, explains how we handle your personal information.

  • You must be at least 13 years old, and at least the minimum age of digital consent in your country, to use the Service.
  • If you are under 18, or under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.
  • You may not use the Service if we have previously banned you, or if you are prohibited from receiving the Service under applicable law.
  • Where required by law, we may use age signals from app stores (such as Google Play) or other age assurance measures. We may restrict or close an account if we have reason to believe the user does not meet these requirements.
  • Accurate information: provide accurate information when you register and keep it up to date.
  • One person per account: do not create an account for someone else without their authorization, and do not impersonate anyone.
  • Security: keep your password and sign-in methods secure. You are responsible for activity under your account. Tell us immediately at destek@timofy.site if you suspect unauthorized use.
  • Usernames: we may reclaim or change a username that infringes someone else's rights, impersonates someone, or otherwise violates these Terms.
  • No transfers: your account is personal to you. You may not sell, rent, transfer, or give away your account or username.
  • Timofy lets you create a profile, share posts and stories, send messages, keep memories in a Memory Book, share memories and play memory games with friends, and view memories on a map.
  • Some features require a paid subscription, and storage allowances depend on your plan.
  • We may offer features labelled as beta or experimental. They may change or be removed and may not work as expected.
  • Features such as bond scores, top-friends statistics, and memory game results are calculated from activity in the app and are provided for entertainment. They do not describe the actual state of any relationship.
  • The Service requires an internet connection. Your mobile carrier's data charges may apply.

Your privacy matters to us. Our Privacy Policy at https://timofy.site/gizlilik explains what information we collect, how we use and share it, how long we keep it, and how you can delete your account and data.

"Your Content" means anything you post, upload, send, or otherwise make available through the Service, including photos, videos, audio, text, comments, messages, and memories. You keep ownership of Your Content.

You grant MCCLabs a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process (for example, compress, resize, or transcode), adapt for formatting, display, and distribute Your Content, solely to operate, provide, secure, and improve the Service and in line with your privacy settings. We may extend this license to our service providers only as needed to provide the Service, and it may be transferred only as part of a business transfer described in our Privacy Policy.

This license ends when you delete Your Content or your account, except for:

  • content you shared with others that they have kept, such as messages in a conversation that has not been deleted;
  • residual copies in backups, for the limited period described in our Privacy Policy;
  • content we must keep to comply with the law, enforce these Terms, or protect safety.

We do not claim ownership of Your Content, and we do not sell it or use it for advertising.

You are solely responsible for Your Content. By posting it, you confirm that:

  • you own it or have all the rights needed to share it and to grant the license above;
  • you have the consent of any identifiable person who appears in it, where the law requires consent;
  • it complies with these Terms and with applicable law.

We have zero tolerance for objectionable content and abusive users. You must not post, send, or share content that:

  • sexually exploits or endangers children, including child sexual abuse material or any content that sexualizes minors (see Section 7);
  • is sexually explicit, pornographic, or contains nudity, or offers sexual services;
  • is intimate imagery shared without the consent of the person shown, or is used for sextortion;
  • promotes hatred, violence, or discrimination against people based on race, ethnicity, national origin, caste, religion, disability, age, sex, gender, gender identity, sexual orientation, veteran status, or any other protected characteristic;
  • bullies, harasses, intimidates, stalks, or threatens anyone, or reveals someone's private information (such as a home address, phone number, or identity document) without consent;
  • threatens, incites, or glorifies violence, or contains graphic or gratuitously violent content, including animal cruelty;
  • supports, promotes, or recruits for terrorist or violent extremist organizations;
  • promotes or encourages suicide, self-harm, or eating disorders;
  • promotes or facilitates illegal activity, including the sale of illegal drugs, weapons, or explosives, human trafficking, or other regulated goods and services;
  • is fraudulent or deceptive, including scams, phishing, pyramid schemes, and fake giveaways;
  • is spam, or is misinformation likely to cause real-world harm (for example, about health, public safety, or elections);
  • impersonates any person or organization or misrepresents your affiliation with them;
  • infringes anyone's copyright, trademark, privacy, publicity, or other rights;
  • contains malware or links to malicious or deceptive websites;
  • otherwise violates applicable law or Google Play's Developer Program Policies.

We may remove content or restrict accounts that create a risk of harm even if they are not specifically listed above.

Paid features do not exempt anyone from these standards, and no feature of the Service rewards or monetizes objectionable content.

  • In the app: tap the menu on any post, story, comment, message, or profile and select "Report". Choose the reason that fits best, such as spam or misleading content, harassment or hate speech, sexual content or nudity, violence or dangerous content, or copyright infringement.
  • By email: contact destek@timofy.site. For child safety concerns, contact destek@timofy.site.
  • Confidentiality: we do not tell the reported user who reported them.
  • Review: we aim to review reports within 24 hours, and we prioritize reports involving child safety or an imminent risk of harm.
  • Emergencies: if someone is in immediate danger, contact your local emergency services first.

Knowingly submitting false or abusive reports is a violation of these Terms.

  • Block: you can block any user from their profile or from a conversation. A blocked user cannot message you, see your content, follow you, or interact with you through the Service's features, and is not notified that you blocked them. You can unblock users at any time in your settings.
  • Mute and hide: you can mute accounts and stories or hide content from specific authors without them being notified.
  • Audience controls: you can make your account private, limit your story audience to close friends, control who can interact with you, and turn read receipts on or off.
  • We review content using user reports and human review, and we may use automated tools to detect spam and abuse.
  • We are not obligated to monitor all content, but we may review, restrict, or remove any content at any time.
  • Enforcement actions include removing or restricting content, issuing warnings, limiting features, suspending accounts temporarily, banning accounts permanently, taking measures to prevent banned users from returning, and reporting illegal activity to law enforcement.
  • Unless the law prohibits it or it would put anyone at risk, we will tell you about an action taken against your content or account and the reason for it. You can appeal as described in Section 12.4.

Timofy prohibits child sexual abuse and exploitation ("CSAE"). These standards apply to all content and behavior on the Service.

  • Zero tolerance: we prohibit child sexual abuse material ("CSAM"), grooming, sextortion, the sexualization of minors, soliciting minors for sexual purposes, and child trafficking, in any form.
  • Immediate action: when we become aware of CSAE, we remove the content, permanently ban the accounts involved, and preserve relevant information as required by law.
  • Reporting to authorities: we report CSAM to the National Center for Missing & Exploited Children (NCMEC) and to competent national and regional authorities, as required by applicable law.
  • In-app reporting: you can report any content or user directly in the app, as described in Section 6.5.
  • Child safety point of contact: our designated contact for child safety matters, including our CSAM prevention practices, can be reached at destek@timofy.site.
  • Legal compliance: we comply with applicable child safety laws and regulations.

If a child is in immediate danger, contact your local law enforcement right away.

Use the Service lawfully and respectfully. Do not use it to violate any law or anyone's rights, or to harm, deceive, or exploit others.

You must not:

  • decompile, reverse engineer, disassemble, or attempt to derive the source code of the app, except where applicable law expressly permits it despite this restriction;
  • modify the app, create derivative works of it, or use unofficial or modified clients to access the Service;
  • bypass or interfere with security features, app integrity checks, access rules, rate limits, storage limits, or subscription entitlements;
  • access non-public parts of the Service, or another user's account or data, without authorization;
  • probe, scan, or test the vulnerability of the Service without our written permission (please report security issues responsibly to destek@timofy.site);
  • scrape, crawl, or harvest data from the Service, or access it using bots or other automated means;
  • extract or misuse API keys, credentials, or other secrets embedded in the app;
  • disrupt or overload the Service, including through denial-of-service attacks, or introduce malware.

You must not:

  • create fake accounts, or use multiple accounts to evade a restriction or ban;
  • buy, sell, or trade followers, likes, comments, views, or other engagement, or take part in coordinated inauthentic behavior;
  • manipulate bond scores, memory games, rankings, recommendations, or search results;
  • send spam or unsolicited bulk messages;
  • mass-report content or users, or abuse the reporting system;
  • contact someone who has blocked you through another account;
  • sell, rent, or squat on accounts or usernames;
  • exploit bugs, or abuse purchase, trial, or refund mechanisms (please report bugs to destek@timofy.site instead).

You may not use the Service for unauthorized advertising, commercial solicitation, or any commercial purpose without our prior written consent.

  • Purchases through Google Play: paid features are sold through Google Play Billing. Prices, billing periods, and included features are shown in the app and on Google Play before you buy. Applicable taxes may apply.
  • Automatic renewal: subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before the renewal date. Google Play charges the payment method linked to your Google account.
  • Cancellation: you can cancel at any time in the Google Play Store under Profile > Payments & subscriptions > Subscriptions. You keep access until the end of the current billing period. Uninstalling the app or deleting your account does not cancel your subscription.
  • Free trials and introductory offers: a trial or introductory offer converts to a paid subscription at the end of the offer period unless you cancel before it ends. Eligibility may be limited.
  • Price changes: we will notify you in advance of price changes as required by Google Play and applicable law, and we will ask for your consent where required.
  • Refunds: refunds are handled under Google Play's refund policies. You can request a refund through Google Play. Nothing in these Terms limits your statutory rights.
  • Right of withdrawal: if you are a consumer with a statutory right of withdrawal, you agree that paid digital features begin immediately after purchase and that, to the extent permitted by applicable law, you lose the right of withdrawal once they begin.
  • End of subscription: premium features and any additional allowances end when your subscription ends.
  • No cash value: any virtual benefits have no monetary value and cannot be exchanged for cash.

The Service, including the app, software, design, graphics, text, logos, and the Timofy and MCCLabs names and trademarks, is owned by MCCLabs or its licensors and is protected by intellectual property laws. Except for the limited license below, these Terms do not grant you any rights in them. This section does not apply to Your Content or to third-party content.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the app on Android devices you own or control, for your personal, non-commercial use. Your use of the app is also subject to the Google Play Terms of Service.

The app includes open-source components licensed under their own terms. You can find these licenses at https://timofy.site/licenses and in the app's settings.

If you send us ideas or suggestions, we may use them without any obligation to you.

If you believe content on the Service infringes your copyright or other intellectual property rights, report it in the app using the "Copyright infringement" reason or send a notice to destek@timofy.site that includes:

  • a description of the work you believe has been infringed;
  • a link to or clear description of where the infringing material is located on the Service;
  • your name, address, telephone number, and email address;
  • a statement that you believe in good faith that the use is not authorized by the rights holder, its agent, or the law;
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on its behalf;
  • your physical or electronic signature.

If your content is removed and you believe this was a mistake, you can send a counter-notice to destek@timofy.site. We terminate the accounts of repeat infringers in appropriate circumstances.

  • Third-party content: GIFs are provided by GIPHY and Tenor. Maps are provided by MapTiler and CARTO using data © OpenStreetMap contributors. Place data is provided by Foursquare. This content is subject to the providers' own terms, and we are not responsible for it.
  • Google Play: these Terms are between you and MCCLabs, not Google. Google is not responsible for the Service or its content. The Google Play Terms of Service also apply to your download of the app and to purchases made through Google Play.
  • External links: the Service may link to third-party websites and services that we do not control. We are not responsible for their content, policies, or practices.

You can stop using the Service at any time. You can delete your account in the app at Settings > Delete my account or request deletion at https://timofy.site/hesap-silme. Section 11 of our Privacy Policy explains what is deleted and what may be kept.

We may suspend, restrict, or terminate your account or access to the Service, with or without prior notice, if:

  • you violate these Terms, including the Content Standards or the Child Safety Standards;
  • we are required to do so by law or by a competent authority;
  • your use creates a risk of harm or legal exposure for other users, third parties, or MCCLabs;
  • we detect fraudulent, abusive, or unauthorized activity on your account.

We may terminate accounts immediately and without warning for serious violations, including child sexual abuse and exploitation, credible threats of violence, terrorism, and serious illegal activity.

We may also discontinue the Service or any part of it. If we discontinue the Service entirely, we will give you reasonable advance notice where possible so you can export your data.

  • Your license to use the app ends, and you lose access to your account.
  • Your content may be removed, as described in our Privacy Policy.
  • If we terminate your account because you violated these Terms, you are not entitled to a refund except where required by law or Google Play's policies. If we terminate your account without cause or discontinue the Service, we will refund prepaid, unused subscription fees where required by law or Google Play's policies.
  • Sections 6.2 (to the extent described), 10, 11, 13, 14, 15, 16, and 18 survive termination.

If you believe we made a mistake in removing your content or restricting your account, you can appeal by emailing destek@timofy.site within 30 days of the action. Include your username and an explanation. We will review your appeal and tell you the outcome.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that content will be preserved without loss. Timofy is not a backup service. Please keep your own copies of photos, videos, and other content that matter to you, and use the data export feature regularly.

We are not responsible for content posted by users or third parties.

Nothing in these Terms excludes or limits warranties or rights that cannot be excluded or limited under applicable law, including your rights as a consumer.

To the maximum extent permitted by applicable law:

  • MCCLabs and its owners, employees, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, content, or goodwill, arising from or related to your use of or inability to use the Service;
  • our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100 (or the equivalent in Turkish lira).

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be limited or excluded under applicable law, including Article 115 of Turkish Code of Obligations No. 6098 and mandatory consumer protection laws.

To the extent permitted by applicable law, you agree to indemnify and hold harmless MCCLabs and its owners, employees, and service providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your violation of these Terms, or your violation of anyone else's rights. This section does not apply to consumers where applicable law prohibits it.

  • Governing law: these Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules.
  • Informal resolution: before starting formal proceedings, please contact us at destek@timofy.site so we can try to resolve the dispute informally within 30 days.
  • Jurisdiction: subject to the consumer rights below, the courts and enforcement offices of Manisa, Türkiye have jurisdiction over any dispute arising from these Terms.
  • Consumers: if you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts where you live. Consumers in Türkiye may apply to Consumer Arbitration Committees or Consumer Courts within the monetary limits set under Consumer Protection Law No. 6502.
  • We may add, change, or remove features of the Service at any time.
  • We may update these Terms. If we make material changes, we will notify you in the app or by email at least 15 days before they take effect.
  • If you keep using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
  • Entire agreement: these Terms, our Privacy Policy, and any additional terms we present for specific features make up the entire agreement between you and MCCLabs regarding the Service.
  • Severability: if any provision is found unenforceable, the remaining provisions stay in full effect.
  • No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment: you may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
  • Language: if these Terms are provided in more than one language and the versions conflict, the Turkish version prevails, unless applicable law requires otherwise.
  • Notices: we may send you notices in the app or to the email address on your account. You can send notices to us at destek@timofy.site.
